Transgender Worker Fired After Surgery Has Leave Claim
A federal judge ruled that Adrian Duane, a transgender former employee of IXL Learning Inc., adequately stated a leave interference claim against the company. This ruling extends workplace bias claims against transgender employees to cover denial of employer-provided insurance coverage in addition to workplace discrimination. Duane argued that when IXL Learning fired him eight days after returning from phalloplasty surgery, the company failed to provide job-protected leave. IXL Learning stated that Duane was fired following the negative comments he wrote about the company on Glassdoor.
