Court Upholds T-Mobile’s Positive Workplace Environment Rules
The 5th Circuit Court of Appeals reversed a lower court decision in an NLRB case against T-Mobile involving alleged NLRA violations in company’s employee handbook. The claims against T-Mobile revolve around their positive workplace environment policy, which encourages employees to maintain a positive work environment, bans all photos and audio and video recording in the workplace, and prohibits accessing electronic information of any kind by non approved individuals. The Labor Board claims that all aspects of T-Mobile’s positive workplace environment policy discourage employee’s from engaging in protected concerted activities as well as unionizing. After three years of battling in court, the 5th Circuit Court of Appeals rejected the Board’s complaints.
