NLRB Says Federal Labor Law Doesn?t Apply to Indian-Owned Casino Protected by Treaty
The NLRB ruled that the Chickasaw Nation is not required to operate within the NLRA because it is a sovereign Indian nation. Tribal leaders are now not subject to being tried for an NLRA 8(a)(1) violation. This ruling could aid the Senate Committee on Indian Affairs as they prepare legislation banning NLRB jurisdiction over businesses owned and operated on Indian lands.
