Coronavirus Telework Challenges Disability Accommodation Defense
As companies move to more "social distancing" policies regarding employment, employers will have to forced to reckon with arguments frequently used in court to defend against accommodating workers’ disabilities. Often in defense against accommodating workers' disabilities employers argue that telework prevents employees from performing essential job functions that employers say include in-person attendance at work. However, as more companies move towards telework the argument is losing its validity.
