Supreme Court to consider the strike power of unions in upcoming case
The US Supreme Court has decided to take a case that will consider the strike power unions hold. The case, Glacier Northwest, deals with whether the federal labor law preemption doctrine blocks state lawsuits, and if an exception is found there would likely be a surge in costly lawsuits by employers against striking unions. While the exception would be limited, there are fears that the court may do away with the Garmon doctrine entirely. Such an exception would threaten to weaken labor law and undermine the bargaining power of unions.
