Ford, UAW Must Arbitrate Worker Firing Again, Appeals Court Says
A federal appeals court ruled that Ford and the United Auto Workers must return to arbitration over the firing of a unionized employee who admitted to lying during an earlier workplace harassment investigation. An arbitrator had previously ordered Ford to reinstate the worker following the initial dispute, but the company later fired him again based on his admission of dishonesty. The Second Circuit agreed that the second termination presented materially different circumstances and therefore constituted a new dispute subject to the collective bargaining agreement’s arbitration process. The decision reinforces the role of grievance arbitration in resolving discipline and termination disputes involving unionized employees. Bloomberg Law
