Contractor Colleges Walk Bathroom Tightrope with Student-Employees
Depending on whether or not the Labor Department's Office of Federal Contract Compliance Programs (OFCCP) views student workers as college employees, the students may or may not be covered by anti-bias rules. These anti-bias rules would allow transgender student workers to use restrooms consistent with their gender identity. This protection is no longer guaranteed for all students following the Trump Administration's rejection of the understanding that Title IX of the 1972 Education Amendments Act guarantees transgender students the right to use bathrooms and locker rooms aligned with their gender identity. The question of whether or not student workers are classified as employees is highly controversial, especially if the student is not receiving work-study financial aid.
