Federal appeals court to decide whether fifty years of OSHA workplace safety rules will be upheld or struck down
In the Sixth Circuit Appeals Court, oral arguments were heard on Thursday for a case regarding the legality of OSHA's workplace safety requirements, and whether Congress delegated too much authority to the Occupational Safety and Health Administration to decide on its own what protections and safety regulations should be put in place. If this case were to be decided against OSHA, it would strike down over fifty years of safety regulations. However, in earlier decisions, the Supreme Court has approved OSHA's power to create health and safety standards within limits. Worker safety advocates believe in the system and want OSHA to be upheld, while others claim that companies' fear of lawsuits will fill the gap of removing OSHA and industries will self-regulate more effectively.
