High Court Takes Up Key Pension Case
The Supreme Court will decide whether retirees are eligible for full pension benefits if they take a new job in the same industry after retirement. The "anti-cutback rule" bars pension plans from reducing benefits that have already been earned. However another pension provision allows multi-employer pension plans to suspend benefits to retirees who take a new job in the same industry. The Bush administration has pushed for more flexible pension plans that allow for the temporary suspension of benefit payments.
