Home-Care Industry Wants Wage Rule Reversed by Trump Labor Chief
The National Association for Home Care and Hospice (NAHC) stated Tuesday that they aim to reverse a DOL interpretation of the Fair Labor Standards Act determined during the Obama Administration. Under the current interpretation, only those who work directly for a client to provide “companionship” and other “in-home” domestic services can receive an exemption concerning the federal minimum wage and time-and-a-half overtime pay. While labor secretary nominee Acosta has not stated his opinion on the regulation, previous Labor Secretary Thomas Perez does support the rule as a way to improve wages. NAHC argued that wages for home care workers have not actually improved because employers have reduced work hours to avoid paying overtime costs.
