In case involving Indiana teacher, judges consider workplace protections for LGBT community
The case of Hively versus Ivy Tech Community College is offering a chance for Chicago judges to determine if the Civil Rights Act protects those discriminated against based on sexual orientation. Kimberly Hively is suing Ivy Tech where she was a math teacher because they allegedly denied her a full-time position after someone at the college discovered that she is a lesbian. Greg Nevins, Hively's attorney, utilized the Supreme Court Case Price Waterhouse v. Hopkins as a precedent related to sex, and therefore sexuality, discrimination. Hively's case must prove that the Civil Rights Act covers sexual orientation discrimination before the case can progress to addressing Ivy Tech Community College specifically.
