Judge Says BIA Should Have Fired Worker
A judge found the Bureau of Indian Affairs (BIA) negligent for keeping a worker who was involved in a fatal automobile accident on the job and entrusting him with a vehicle. The worker had five DWI convictions and the judge argued that the employer should have known that he was unfit. However, the judge also ruled that that worker was not acting within the scope of his employment when the crash occurred. Damages have yet to be determined.
