Labor Board Counsel Weighs in on Union Election Rules
Top NLRB prosecutor Peter Robb suggested on Wednesday that the time between when a petition is filed and a unionization election is held be extended from 8 to 12 days. He also suggested that the Board should throw out the rule that blocks an election if an employer is accused of using certain methods of dissuading workers from voting in favor of unionizing. Robb is facing some push back from within the NLRB on these issues, and has been working to strip power from regional directors and revise investigation protocols to minimize their decision-making role. As general counsel, Robb already holds substantial power to sway the direction of federal labor policy, and he has not been shy about using that power since his appointment by Trump in December.
