Making Workplaces More Inclusive to Transgender Employees
The New Jersey Law Against Discrimination (LAD), N.J.S.A. 10:5-1 et seq., prohibits the harassment of and discrimination against individuals in the workplace based on membership in any one of several enumerated classes, including race, creed, color, national origin, ancestry, age, marital status, pregnancy, sex, gender, sexual orientation, and disability. In 2006 the New Jersey State legislature the LAD to include gender identity and expression. However, despite the law employers must be proactive in addressing issues such as use of an employee’s favored name and pronoun, dress code, and restroom usage in order to make a truly inclusive workplace for Transgender employees.
