The U.S. Supreme Court declined to hear a case challenging how courts review National Labor Relations Board (NLRB) decisions in the wake of last year’s Loper Bright ruling. That decision ended the Chevron doctrine, which required courts to defer to agency interpretations of ambiguous laws. Valley Health System had argued that the Ninth Circuit improperly deferred to the NLRB’s ruling on union dues, rather than conducting its own analysis. The Ninth Circuit, however, maintained that its decision was based on independent precedent, not deference to the agency. The Supreme Court’s refusal to hear the case leaves the issue unresolved.
