Oregon Supreme Court rules against medical marijuana users
An Oregon Supreme Court took steps this week against the use of medical marijuana in the workplace. The court ruled yesterday in Emerald Steel Fabricators Inc. v. Bureau of Labor and Industries that a prescription for medical marijuana no longer means an employer must accommodate an employee - they can now be fired for drug use. If an employee fails a drug test they can be let go regardless of whether they have permission for medical marijuana or not. The case was taken up after an employee sued Emerald Steel for having been refused a job, saying the company did not accommodate his medical marijuana as required by law. An appeal will still be heard, but experts do not expect the decision to be overturned, given the conservative and business-friendly makeup of the court.
