Rules Sought for Workplace Wellness Questionnaires
Louise Slaughter, a Democrat from New York, is asking the Equal Employment Opportunity Commission to regulate how employers use wellness questionnaires in order to avoid potetial discrimination against employees. The request comes after an increase in more questionable tactics and questions in company wellness programs, such as Pennsylvania State University?s policy requiring a monthly $100 charge if employees did not participate on a basic level as well as objectionable questions asking about martial problems and women?s pregnancy plans. If the request is followed by the EEOC, it could drastically change how employers are allowed to incentivize ?good? health behaviors in employees. The Affordable Care Act allows employers to offer incentives in the form of health coverage costs for employees who complete wellness programs.
