So-Called White-Collar Workers Have Overtime Rights Too: NY Judge Certifies Class of KPMG Audit Workers
A New York district court judge has certified a class of workers that the company had classified as white collar and having supervisory duties, meaning that they would be exempt from overtime laws. The judge said that the title and job description were not as important as the actual duties performed by the workers and the substance of their work. The judge found that the workers in the lawsuit were not supervisors and were therefore entitle to overtime under the Fair Labor Standards Act.
