Some companies need to file a WARN notice to notify employees of upcoming layoffs, while others don’t
The federal WARN Act protects employees from surprise mass layoffs and requires companies to provide at least a 60-day notice of mass layoffs or closure of worksites. Various employees at SkyWest Airlines in Utah have been notified that they will be affected by upcoming layoffs in September. The Skywest Airlines workers will have the opportunity to transfer to Skywest positions in other locations or to transition to Delta Airlines, a Skywest partner. However, many companies that lay off their employees do not file a WARN notice and employees are affected by sudden layoffs. The WARN Act requires a notice to be filed if the layoffs are above a certain threshold, and the layoffs occur in the same workplace. Pluralsight, a Utah tech company, laid off over 400 employees but did not have to file a WARN notice because the layoffs were at multiple locations.
