Supreme Court will weigh expanding Trump’s power to shape independent agencies
The U.S. Supreme Court has agreed to hear a case that could significantly expand President Donald Trump’s authority over independent federal agencies by revisiting a 90-year-old precedent that limits when presidents can remove board members. The case centers on FTC Commissioner Rebecca Slaughter, whose removal was blocked by a lower court based on the 1935 Humphrey’s Executor decision. The Justice Department argues that presidents should have broad authority to remove agency officials in order to effectively implement their agenda. Opponents warn that allowing such firings could politicize regulatory bodies and undermine congressional intent.
