US Court of Appeals overturns NLRB’s ruling regarding Elon Musk’s anti-union tweets
A United States Court of Appeals ruled that the National Labor Relations Board order for Elon Musk to delete his anti-union tweets should be overturned. The National Labor Relations Board found the tweets to be an unlawful threat against union workers, but the court rulings determined that the tweets were protected under the Constitution’s First Amendment. The court did not issue a ruling on whether or not the tweet violated the National Labor Relations Act. The tweet stated that union workers would have to give up stock options. The National Labor Relations Board will also be required to reconsider its ruling that ordered Tesla to rehire an employee who was fired because of pro-union efforts.
