Wisconsin still denies unemployment claims for people on disability
A federal judge ruled in July 2024 that Wisconsin’s 2013 law blocking Social Security Disability Insurance (SSDI) recipients from receiving unemployment benefits violates federal disability protections. Despite this, the Wisconsin Department of Workforce Development (DWD) has continued denying claims from disabled workers, frustrating plaintiffs like Judy Fintz and Cliff Neuman. The court has not yet issued a final remedy or injunction, and disputes remain over who qualifies for relief. DWD has not appealed the ruling but argues it’s not yet enforceable. Advocates say continuing to deny benefits unfairly targets people with disabilities and contradicts the judge’s clear finding of discrimination.
