Forced arbitration ban on sexual assault and harassment of employees is on the horizon
Last week Congress passed the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act. Experts estimate that over 60 million Americans are subject to arbitration clauses that require plaintiffs to pursue lawsuits via private arbitration rather than in civil court. President Joe Biden has signaled his support and is expected to sign the bill into law shortly. This act would prohibit employers and businesses from using pre-dispute arbitration clauses in the workplace for sexual assault and harassment claims.
